Regulation establishing the Union Customs Code and the European Union Customs Authority

This document provides FEPORT’s feedback on the EU Commission’s proposal for a Regulation establishing the Union Customs Code and the European Union Customs Authority, dated October 2023. FEPORT welcomes the reform proposal, particularly the introduction of an EU Customs Authority and an EU Customs Data Hub, which are seen as having the potential to simplify customs procedures for trusted traders and enhance supply chain supervision to combat illicit trade.

While supporting the abolishment of guarantees for goods held in temporary storage, terminal operators express concern that the newly proposed rules for temporary storage could lead to inefficiencies. The document elaborates on these concerns and offers recommendations to improve the proposed rules, especially regarding risk management.

FEPORT advocates for aligning definitions and procedures for scanning “high-risk” cargoes across the EU, particularly among major EU gateway ports. They argue that differing levels of “strictness” could be exploited by organized crime, and a harmonized approach would positively impact the level playing field among EU ports.
